The current Board of Directors of the Royal Andalusian Golf Federation – headed by its President, Ángel de la Riva – is very satisfied with the ruling handed down by the Court of Administrative Disputes, which upholds the existence of electoral fraud that the candidacy of the current President denounced from the outset, and which will allow the holding of new elections for the Sports Association category within the most absolute legality.
The sentence of the Administrative Court number five of Seville, which declares the existence of fraud in the elections to the General Assembly of the Royal Andalusian Golf Federation for the category of Sports Associations, and which forces to repeat the elections for this category, is now final. With the finality of this sentence, the Justice gives reason to the Aloha Golf Club, member of the candidacy of the current President of the RFGA, Angel de la Riva.
After the elections were held in July 2012, the Aloha Golf Club denounced before this Court the existence of errors in the electoral roll, which had included at least two clubs (Doñana Club de Golf and Club de Golf Benalmádena) which, at the date the elections were called, were not registered in the Federation.
The plaintiff added in his appeal that these clubs -being aware of the error- had participated in the elections, voting and presenting their candidacies, even Doñana Club de Golf being elected member of the Assembly of the Royal Andalusian Golf Federation by the list proposed by the opposing candidacy to Ángel de la Riva, thus modifying the result of the elections of a body to which they did not belong at the date of publication of the census.
Now, this court upholds the lawsuit filed by Aloha and declares the existence of electoral fraud and fraudulent intent on the part of these clubs, which, knowing that they had been removed, altered the democratic rules of the elections by voting and presenting their candidacies.
With this, it also declares the nullity of the electoral procedure with regard to that category, whose votes were held on July 6, 2012 at the Real Club de Golf Guadalmina, and which must now be repeated, after the preparation of a new census that complies with the legally established requirements.
